REGULATORY COMMITTEE

 

Our mission is to perform a legal supporting function assisting fellow committees and the AmCham Board, and operating as a workshop for many of the most highly skilled practicing attorneys in Hungary and the representatives of AmCham member companies.

We recognize the growing need for representing the interests of AmCham members in the Hungarian regulatory procedures in an effective manner. The Regulatory Committee aims to ensure that constructive, professionally grounded comments and proposals are issued under the AmCham header in line with the reputation of the organization. The Committee functions as a professional network of specialized working groups for different areas of law.

AmCham has a well-established, formal cooperation framework with the Ministry of Justice and engaged in regular and direct consultation on its legislative proposals with Government experts. This renewed Strategic Partnership Agreement – originally signed in 2011 – serves as a manifestation of a closer cooperation between the business sector and legislators. This Agreement facilitates Committee members to be informed on the legislative agendas and involved in the current regulatory work with the opportunity to give their opinion.

Furthermore, in spring 2024, AmCham also signed a Strategic Partnership Agreement with the Ministry of EU Affairs of Hungary. The Agreement enables our members to be informed on the legislative agendas and provides them with the opportunity to consult on questions within the Ministry's responsibility during and after Hungary's Presidency of the Council of the European Union set for the second half of 2024.

 Highlights of 2024

  • Business Forum with János Bóka, Minister for European Union Affairs
    On May 07, AmCham welcomed Mr. János Bóka, Minister for EU Affairs of Hungary, to a Business Forum, where the parties discussed, ahead of the upcoming Hungarian Presidency of the Council of the EU, the priorities of the Presidency and relations between Hungary and the EU. Following the Minister's presentation, they signed a Strategic Cooperation Agreement to strenghten cooperation between businesses and the Ministry. Cooperation_signing

     

  • Consultations on the new regulations of third country workers
    On March 27, we welcomed Dr. Szilvia Konyhás, Director of the National Directorate General for Alien Policing, and Dr. Tamás Jáczku, Head of Department at the Deputy State Secretariat for Employment and Programs for a joint HR-Regulatory Committee meeting to discuss the new regulations on the employment and residence of third-country citizens in Hungary.

    Shortly afterwards, on June 13, the committee invited Dr. Szilvia Konyhás, Director of the National Directorate General for Alien Policing, to continue the dialogue on latest regulations of the employment and residence of third-country citizens in Hungary as well as the implementation of decrees.
     
  • Introductory meeting with János Bóka, Minister for European Union Affairs - February 2024
    On February 9, AmCham's representatives met with János Bóka, Minister for European Union Affairs to discuss opportunities for future cooperation, in preparation for Hungary's upcoming EU Presidency.
     
  • Introductory meeting with Director of National Directorate General for Aliens-Policing Dr. Szilvia Konyhás, State Secretary for Employment Dr. Sándor Czomba and  Deputy State Secretary for External Economic Affairs Katalin Bihari - October 2023
    The three meetings gave place to discussions related to the employment and the administrative procedures of third-country workers and the guest workers’ bill.
     
  • Partnership Agreement with the IVSZ – the ICT Association of Hungary
    AmCham Hungary and IVSZ– the ICT Association of Hungary have signed an agreement of cooperation in May 2023 to support each other in achieving their common goals including the development of the digital economy in Hungary and the country’s competitiveness.

  • Meeting with State Secretary László Salgó and Deputy State Secretary Kupecki Nóra from the Ministry of Justice - October 2022
    On October 12, the Regulatory Committee hosted State Secretary Dr. László Salgó and Deputy State Secretary Dr. Nóra Kupecki, responsible for constitutional legislation and consumer protection, to establish closer cooperation and learn more about the government’s legislative agenda. We discussed several legislative issues, the committee’s proposals on consumer protection, and the Advertisement Act. Moreover, the committee submitted comments on the draft collective action law based on the obligation to implement the EU Directive on Consumer Representative Actions.
     
  • Online meeting on the cybersecurity legislation - June 2022
    A small expert group of the Regulatory Committee met online on June 1 to work together and formulate recommendations to improve the cyber security regulation.
     
  • Second round discussion on the legislation of digital services at the Regulatory Sub-Committee meeting - May 2022
    Led by Dr. Judit Firniksz (Vodafone), Regulatory Sub-Committee members in the framework of the committee meeting agreed to continue work together on proposals for the governmental legislators to clarify the terminologies for digital products and improve the coherence of different levels of the EU and domestic legislation.
     
  • Consumer Protection Regulatory Changes in Focus of Regulatory Committee - May 2022
    The aim of the meeting on May 10 was to discuss the diverging interpretations of paragraph 62 (1) (n) of Act No CXLIII of 2015 on the Public Procurement and develop a common position.
     
  • A new Regulatory Sub-Committee has its kick-off meeting on Digital Services - April 2022
    Members of the new Digital Services Sub-Committee during the kick-off meeting discussed the four subtopics they wish to work on in the upcoming months. The main subtopics were: Consumer protection and digital advertising legislation, EU regulatory initiatives for digital markets, Revision of the PSD2 Directive in the light of digital processes and Cybersecurity and digital identity
     
  • Regulatory Committee Forms Groups to Address Competition Rules, Labor Law, Single Digital Market Regulation and More - March 2022
    Committee members during an online meeting discussed the most relevant issues related to the legal regulatory environment, and agreed to set up several temporary working groups to continue the professional consultation on targeted topics such as public procurement procedure in case of cartels, the changes in the application of consumer regulatory framework, the competition rules and the single digital market regulation, and some labor law implementation obligations based on EU directives.
