May 6, 2021 – Global law firm Dentons successfully represented the most credited provider of advanced diagnostic imaging, outpatient and cancer care services in Europe in defeating a medical malpractice case.
In his claim against the client and another healthcare provider before the Budapest Metropolitan Court, the plaintiff alleged that the defendants failed to properly diagnose his illness which resulted in serious damage to his spine. The plaintiff further claimed that the impairment of his health had a causal relationship with the misdiagnoses by the two defendants, both in terms of a subsequent drastic surgery and the nervous system symptoms which followed. The plaintiff requested that the court establish that the defendants are jointly and severally responsible for his health damage, and order them to pay him compensation for non-material damages, a life annuity per month, and litigation costs.
Following four years of litigation and a detailed examination of medical records, Dentons’ representation of the client was successful, and the plaintiff’s claim was dismissed by both the first and second instance courts.
“We view this major European healthcare provider as a strategic client. They have retained us to advise them on numerous matters over the years – which is a clear endorsement of both the high standard of work we provide and of our efforts to build a strong, long-term relationship,” said partner István Réczicza, Head of the Dispute Resolution and Litigation and Life Sciences groups in Budapest.
Associate Mihály Czesznak led the legal team, which also included counsel Lilla Király and associate László Fenyvesi.
