The new EU framework on equal pay aims to reduce or eliminate unjustified gender pay gaps. Directive 2023/970/EU imposes several obligations on (almost) all employers to enhance transparency in wage regulations. The directive's rules must be implemented into national law by June 7, 2026. However, the new obligations for employers make it advisable for stakeholders to begin preparations as soon as possible.

Under the new rules, employers will have several new reporting obligations, including preparing reports on individual and average wage levels of employees, providing information on the salary range for job applicants, and demonstrating the criteria used to determine employee remuneration, wage levels, and salary increases (salary determination and wage growth policies). Additionally, employers will be required to submit annual reports on the gender pay gap and the proportion of male and female employees receiving supplementary or variable pay components.

Employers must also prepare for cases where wage reports indicate at least a 5% difference in average salaries between male and female employees within any job category. In such instances, a joint pay assessment must be conducted with employees to identify and address any unjustified gender pay disparities. Employers will be required to implement corrective measures within a reasonable timeframe, which may include analyzing or establishing gender-neutral job evaluation and classification systems.

The directive outlines extensive employer obligations, making early preparation advisable. Developing the necessary policies and reports requires assessing the current pay structure and taking proactive steps to address existing wage disparities or justify them objectively. Since modifying wage structures and salary levels often takes time and involves various economic considerations, it is strongly recommended to initiate these processes now.

With more than ten years of experience in this field, Barnabás has in-depth knowledge of the constantly changing Hungarian labour regulations. In addition to handling everyday employment matters, he has experience in employment restructuring, preparation of executive and general employment contracts, employment related litigation, as well as advising on immigration law matters.

Barnabás also focuses on data protection law, including data protection compliance, data protection policies and procedures, data transfer in outsourcing projects and M&A transactions, cross-border data transfers and employee monitoring. He also specialises in corporate investigations, compliance, corporate criminal liability/white collar crime, sanctions and asset recovery matters.

Barnabás is a regular lecturer on all employment law topics at Corvinus University of Budapest.
Marietta Molnár, Senior Associate, Wolf Theiss
Marietta Molnár is a member of the Employment team in Budapest. Marietta specialises in employment law for sectors such as logistics and transports, retail and distribution, banking and finance, and telecommunications. She has many years of experience drafting, reviewing and observing employment contracts, various employment-related documents and creating strategies (e.g. collective redundancy, reorganization, outsourcing, transfer of business).

Marietta is also practiced in attending labour courts, drafting and filing court documents, conducting numerous due diligence reviews and transactions as well. Marietta is active in the dissemination of employment culture, e.g. delivering internal and external presentations, including client seminar and preparing articles on various topics related to employment law.
